The 48 Hours After the Polls Close Are Where Campaigns Fall Apart

Campaigns lose in the two days after voting more often than they will ever admit, and the losses are avoidable ones.

The team disperses before anybody collects the documents. Somebody with a phone and no authority says something that cannot be taken back. Payments are made in a rush and remembered badly for years. And the clock on anything you might want to challenge starts running while everyone is asleep.

Plan these 48 hours the way you planned the morning of 10 August 2027, because unlike the morning they arrive when your whole organisation is exhausted.

Your documents are now evidence, and they need a custodian

The moment the count ends, your signed copies stop being paperwork and start being the only account of the day your campaign controls.

Name one custodian before the election. Every signed form copy, every photograph, every incident note and every tally watcher's objection goes to that person, and they log what they receive against your list of streams.

Do it within 24 hours. Not because anything is likely to be disputed, but because documents that are still with individuals after two days are documents that will never be gathered. People go home, phones are wiped, envelopes end up in vehicles that have been returned to their owners.

The custodian's log is also how you find out something useful and slightly painful: which streams produced no copy at all. That number tells you exactly how much of your agent operation actually worked.

The clocks that start at declaration

Two, and both are short.

A presidential petition is filed at the Supreme Court within 7 days of the declaration and determined within 14 days. Every other election petition, from governor down to MCA, is filed within 28 days of the declaration of that result.

Twenty-eight days sounds generous until you consider what has to be inside the filing. Specific grounds, specific stations, specific figures, supported by documents you either collected on the night or did not.

So the decision that actually matters is made before you know whether you need it. Collect and log everything, then take advice quickly, and be prepared to be told that you have a grievance rather than a case. Those are different things, and a campaign that cannot tell them apart spends money it does not have on a filing that was never going to succeed.

Say nothing you cannot stand behind

Between the close of polls and the declaration there is a window in which every rumour in the constituency is treated as information.

One voice speaks for the campaign, as agreed on your command card. Everybody else is asked, explicitly, to post nothing. Not a projection, not a celebration, not an accusation.

The reason is practical rather than moral. A campaign that claims victory before declaration and then loses looks foolish, and a campaign that alleges fraud at midnight and cannot produce the stream and the figure by morning has spent the credibility it will need if a real problem emerges. Hold the specific facts, and say only what your own forms support.

Pay people off properly, because it decides your next campaign

Within the two days, close out every payment you owe.

Pay the balances against your list, by name, by phone, from the campaign account, exactly as you set out months earlier. Somebody who did the work and is paid on the second day will work for you again. Somebody still chasing a balance three weeks later will tell everybody in their ward, and they will be right to.

Collect what belongs to the campaign at the same time: unused materials, branded items, hired equipment, vehicle keys. It is far easier while people are still thinking of themselves as part of the campaign.

Winning and losing, both in public

If you have won, thank the team by name and in public, then say something generous about the people who did not vote for you. You now represent them too, and the first 48 hours is when that is heard.

If you have lost, the same discipline applies for a harder reason. A concession made cleanly, with a challenge reserved on stated grounds if you intend to bring one, preserves everything you have built. Bitterness in public on the second day costs a candidate more over the following five years than the seat itself was worth.

Either way, there is one more thing to do while it is fresh.

Debrief before anybody sleeps properly

Within those two days, sit with your day commander and your ward coordinators and write down what actually happened. Which streams went uncovered and why. Which vehicle failed. Which ward reported late. Which agent could not read the form.

Nobody will remember it accurately in a month, and it is the entire raw material for whatever you do next. Give the custodian that document too, in the same file as the forms.

Frequently Asked Questions

How long do you have to file an election petition in Kenya?

A presidential petition is filed at the Supreme Court within 7 days of the declaration and determined within 14 days. All other election petitions, from governor down to MCA, are filed within 28 days of the declaration of that result. The practical constraint is not the deadline but the evidence, which has to have been collected on the night.

What should a campaign do with its results form copies after polling day?

Name one custodian before the election and get every signed copy, photograph, incident note and written objection to that person within 24 hours, logged against your list of polling streams. Documents still sitting with individuals after two days are usually never gathered at all, and the log doubles as an honest measure of how much of your agent operation worked.

Should a candidate claim victory before the declaration?

No. Between the close of polls and the declaration, rumour is treated as information and anything you say is on the record. A premature claim that turns out wrong looks foolish, and an unsupported fraud allegation spends the credibility you would need if a genuine problem emerged. Speak through one agreed voice and say only what your own forms support.
