Do You Have to Resign Your Job to Run for Office in Kenya?

The flag of Kenya

It depends on what kind of job it is. For a large number of Kenyans in public employment the answer is yes, and it comes with a deadline that falls months before anybody votes.

That gap is the whole problem. You resign a salary at one date, and the election falls on 10 August 2027, and everything in between has to be paid for somehow.

The rule, in one paragraph

A person holding public office who wants to contest an elective seat must leave that office by a point fixed in law before the general election. It is a fixed period rather than a date somebody chooses, so the deadline is calculable in advance and does not move.

Related: the date it produces.

Resignation is not a formality you complete on nomination day. Your papers have to show it already happened, which means the letter, the acceptance and the proof all have to exist beforehand.

Who this catches

Broadly, people employed in the public service, and the category is wider than most people assume. National and county government employees. Staff of state corporations and agencies. Teachers in public service. County assembly staff. Members and staff of constitutional commissions and independent offices.

Whether a particular role sits inside the definition is a legal question with a real answer, and the answer is in the Constitution, the Elections Act 2011 and the terms of your own employment.

Two places to ask, and ask both: your employer's human resources office, and the IEBC. Get the answer in writing. A verbal assurance from a colleague who "did it last time" is not evidence, and their circumstances may not have been yours.

Who it does not catch

Sitting elected members are in a different position. A member already holding an elective seat is not required to give it up in order to seek re-election, or to seek a different elective seat.

That is why sitting members can declare for another office without leaving the one they hold, while a public servant contemplating the same ward has to resign first and live on savings. It is an asymmetry worth naming plainly, because it shapes who can realistically afford to run for anything in Kenya.

Resignation is a one-way door

You cannot resign, lose a party primary, and go back to the desk.

Which means the decision has to be taken with the primary calendar in front of you, not the general election. If your party's primary sits after the resignation deadline, you are resigning to enter a contest whose outcome you do not control. Related: how the party route runs.

Three things to establish before you write the letter.

Whether your party's nomination for your seat is by vote, by delegates or by a decision of party organs, because the last one is not something you can campaign your way through.

What your household needs monthly, and where that comes from for the whole period between resignation and the election.

What terminal dues you are owed, when they are actually paid, and whether your plan survives them arriving late. They usually arrive late.

Do the paperwork properly

Give notice in the form your terms of service require. Obtain written acceptance, dated. Collect the clearance and exit documents your employer issues, because several of them feed into other things you will need.

Then keep the whole set with your nomination file, because proof of resignation is one of the documents a returning officer may look for. Related: what else is in that file.

Holding public office when you were required to have left it is a disqualification, not a technicality. Related: what else disqualifies a candidate.

What to do while you are still employed

Everything that does not require you to be a candidate.

Confirm in writing whether the rule applies to your role. Map the resignation deadline against your party's primary timetable and the nomination window. Build the household budget for the unpaid months. Assemble your Chapter Six clearances, because doing that while you still have a salary and working hours is far easier than doing it afterwards.

And be honest with yourself about the primary. The people who regret resigning are rarely the ones who lost the general election. They are the ones who never got onto the ballot at all.

Frequently Asked Questions

Which public officers must resign to contest a Kenyan election?

Broadly, people employed in the public service, which covers national and county government employees, staff of state corporations, teachers in public service, county assembly staff and staff of commissions and independent offices. Whether a specific role falls inside the definition is a legal question answered by the Constitution, the Elections Act and your own terms of employment. Ask both your human resources office and the IEBC, and get the answer in writing.

Do sitting MPs, MCAs or Governors have to resign to run again?

A member already holding an elective seat is not required to give it up in order to seek re-election or to contest a different elective seat. That is why sitting members can declare for another office without leaving the one they hold. A public servant contesting the same seat has to resign first, which is a significant asymmetry in who can afford to run.

When is the deadline to resign before the 2027 election?

The rule sets a fixed period before the general election rather than a date chosen by anyone, so the deadline is calculable in advance and does not move. Work it out against 10 August 2027 and then check it against your party's primary timetable, because resigning before a primary you may not win is a one-way decision.
