How Kenyan Coalition Agreements Actually Work
Kenyan coalition politics is reported as personality and photographed as handshakes. Underneath it is a document with legal effect and a filing deadline, and almost no aspirant ever asks to see one.
What the law requires
Under the Political Parties Act, parties that agree to form a coalition before an election must enter into a written agreement and deposit it with the Registrar of Political Parties, within a period specified by law and in any case before the election.
Coalitions formed after an election are governed separately and deposited on a different timeline.
The distinction matters. A pre-election coalition is the framework inside which nominations happen; a post-election coalition is about forming a government.
What a coalition agreement contains
Typically:
The parties, and their obligations to each other.
The coalition's governing organs — who decides what, and by what majority.
How the presidential candidate is selected, if the coalition is fielding one.
Arrangements about candidates — which is where zoning lives.
How the coalition can be dissolved, and what happens to member parties afterwards.
Dispute resolution, internally and through the Political Parties Disputes Tribunal.
The clause that decides your candidacy
Look for the one governing nomination of candidates for elective seats.
It will do one of three things: leave each party to nominate its own candidates independently; establish a joint nomination process; or record that particular seats or regions will be contested by particular parties.
That third option is zoning, and it is the one that removes seats from competition without anybody in the constituency being consulted.
What an aspirant can actually do about it
Three things, and they are more than most aspirants realise.
Ask whether an agreement exists and has been deposited. It is a filed document, not a private arrangement, and members of a party have a legitimate interest in its terms.
Ask specifically whether your seat is covered by a zoning provision. Get the answer in writing. A party that will not answer has answered.
Ask when the agreement will be deposited. Coalitions negotiated late are coalitions where seats are traded late, which is worse for you than one settled early.
Why the timing is the thing to watch
A coalition agreement deposited in, say, early 2027 will have settled seat arrangements shortly before party primaries in April and May 2027. An aspirant who learns in March that their constituency has been zoned to a partner has effectively lost the cycle, because the deadline to leave a party and file as an independent is 8 May.
So the useful question is not "will there be a coalition". It is "when will the document be signed, and will I know what is in it before I have to decide anything?"
Related: the primaries timetable.
What happens when a coalition collapses
Worth knowing before joining one, because Kenyan coalitions dissolve routinely.
A coalition agreement will specify how it may be terminated and what happens to member parties afterwards. Parties generally revert to independent existence, and members elected on a coalition arrangement face questions about which party they now belong to — which matters because Kenyan law does not permit membership of two parties at once.
The practical exposure falls on candidates and elected members rather than on principals. A principal whose coalition collapses is still a principal. A ward representative elected under a coalition banner that no longer exists has a party membership question, a symbol question and, potentially, a seat question.
Which is one more reason the durable asset is the structure you built yourself rather than the arrangement you were placed in.
