Public Participation in Your County Is a Legal Requirement. Use It.
Public participation in Kenya is not a public relations exercise a county chooses to hold. It is a legal requirement, and a county that skips it can have its decision set aside.
That is the whole point, and it is the part residents least often realise they are holding.
Where the duty comes from
Several places at once, which is why it is hard to argue away.
Article 10 lists participation of the people among the national values binding every state organ. Article 174 makes enhancing the participation of the people in decisions affecting them an object of devolution. Article 196 requires a county assembly to conduct its business in public and to facilitate public participation in its legislative and other business. Article 201 puts openness, accountability and public participation into the principles governing public finance.
The County Governments Act 2012 then builds the machinery: principles for citizen participation, a duty on counties to create modalities and platforms for it, and a duty to facilitate participation in the assembly. The Public Finance Management Act 2012 adds the County Budget and Economic Forum, the standing body through which counties are meant to consult on plans and fiscal strategy.
Courts have treated inadequate participation as a ground for invalidating county legislation. That is the enforcement, and it is why a stamped submission matters more than a good speech at a baraza.
The moments that are worth your time
Not every forum is equal. Four are.
The county integrated development plan. The five-year plan. Getting a ward priority written in here is worth more than anything said later, because funding has to flow from the plan. Reading the CIDP sets out what to look for.
The county fiscal strategy paper. This is where sector ceilings are set, months before estimates are tabled. Arguing about a budget after this stage is arguing about the margins. The full budget calendar sets out every stage and its date.
The annual county finance bill. This is the county law that sets the fees, charges and rates residents actually pay. Traders, boda riders, market users and landlords have a direct interest here and the shortest route to being heard.
Any bill before the county assembly. Every bill is meant to go through public participation before it is passed, and that includes the ones nobody publicises.
How to make a submission that counts
Turning up and speaking is the weakest form. Do this instead.
Write it down. One page, headed with your name, your ward, a telephone number and the document you are commenting on. State the specific clause, line item or project, say what you want changed, and say why. General complaints get recorded as attendance. Specific asks get recorded as submissions.
Deliver it in person, get it stamped and dated, and keep the stamped copy. If the office will not stamp it, write down the date, the time and the name of the person who received it.
Ask for the report. A participation exercise is supposed to produce a record of who attended and what was submitted, and the county is supposed to say how submissions were treated. Requesting that report is the step almost nobody takes, and it is the step that makes the exercise real.
Then follow your own item into the next document. If the submission was about a project, look for it in the annual development plan and then in the estimates.
If the county holds no forum, or holds a hollow one
A notice posted the day before, in one place, in one language, in a county the size of a small country, is a defence a county will struggle to run.
Record what happened: the notice, its date, where it appeared, who attended, what was tabled and what was not. Then escalate on the record. A petition to the county assembly is a formal route, and the assembly is required to consider it and report back. The parallel process at national level is described in what happens to a petition to Parliament.
What to do in the next participation window
Find the schedule before you need it.
Ask the clerk of the county assembly for the dates of upcoming public participation on bills, and ask the county planning department for the schedule on the development plan and the fiscal strategy paper. Put both in your phone.
Then write your one page now, before any notice appears, so that when the window opens you are handing in a document rather than raising a hand. Between now and 10 August 2027 every county will open several of these windows, and they are the only points at which an ordinary resident's words enter the record carrying legal weight.
Frequently Asked Questions
Is public participation compulsory for county governments in Kenya?
Yes. It runs through Article 10, Article 174, Article 196 and Article 201 of the Constitution, and it is built out in the County Governments Act 2012 and the Public Finance Management Act 2012. Courts have treated inadequate public participation as a ground for invalidating county legislation, which makes it an enforceable requirement rather than a courtesy.
How do I object to a county finance bill that raises my fees?
Submit a written memorandum during the public participation on the bill. Name the specific fee, say what you want it changed to and give the reason, then deliver it in person and keep a stamped copy. Afterwards, ask for the report showing how submissions were treated, and check the passed act against what you asked for.
What happens to a petition sent to a county assembly?
The assembly is required to consider it and report back to the petitioner. In practice a petition is committed to the relevant committee, which may call the petitioner and the department concerned before reporting to the whole assembly. Keeping the acknowledgement and the petition number is what lets you follow it, since the process moves slowly and quietly.
