When Your Agent Is Refused a Copy of the Results Form
It is close to midnight. The count is finished, the figures are entered, and your agent asks for their copy of the form. They are told no, or told to wait, or told the copies have run out.
What happens in the next ten minutes decides whether your campaign has evidence or a grievance. Grievances are worth nothing after the fact.
Teach this as a drill, in that order, and rehearse it until it is automatic.
Step one: ask precisely, and calmly
Vague requests get vague answers. The agent states who they are, which stream they are appointed and accredited to, and that they are requesting the copy of the results form for that stream to which they are entitled.
Name the form. Form 34A for president, 35A for the member of the National Assembly, 36A for the member of the county assembly, 37A for governor, 38A for senator, 39A for the woman representative. An agent who names the form is an agent who is clearly not guessing.
Most refusals end here, because most refusals are not refusals. They are a tired officer at the end of an eighteen-hour day, working through several forms with several agents in the room.
Step two: photograph it
If a copy is not immediately produced, ask to photograph the completed and signed form. Then do it: the whole form in one frame, then close-ups of the figures, the station and stream identifiers, and the signature block.
Photographs go to your operations desk immediately, with the station code and stream in the message. Not to a WhatsApp group where they will be forwarded until nobody can say which stream they came from. This is exactly the point of a structured tally, which is why the figure and the image should stay attached to each other, as in Form 34A to Form 34C.
Step three: object, and make sure it is recorded
If the copy is still not produced, the agent objects and asks that the objection be recorded. This is a power the agent has, and it is set out in what an agent is allowed to do.
In their own notebook, at the same time: the date, the time, the station name and code, the stream, the name and title of the person who refused if it was given, the exact words used as best they can recall, and the names of any other agents in the room who saw it. Contemporaneous notes carry weight. Reconstructed memories do not.
Whether to sign the form is a separate decision. An agent may decline to sign a form whose figures they could not check, and should record why.
Step four: escalate up your own chain first
The agent calls their ward agent, who calls the chief agent. The chief agent is the one who raises it with the returning officer, because the chief agent is the person with that relationship and the standing to use it. This is what the chain of command exists for.
Two reasons to route it this way. The chief agent can see whether this is one tired officer or a pattern across several streams in one ward, and only the pattern is worth escalating hard. And a single agent arguing alone at midnight in a school hall is in a worse position than an agent whose campaign is calling on their behalf.
Step five: preserve everything, that night
Photographs backed up off the phone. Notebook pages photographed. The operations log entry written while people still remember.
This matters because the timelines afterwards are short. A presidential petition is filed at the Supreme Court within seven days of declaration and determined within fourteen. Other election petitions are filed within twenty-eight days of declaration. Nobody assembles usable evidence inside those windows from memory. It is assembled from what was captured at the stream on the night, or it is not assembled at all.
And what the agent must not do, at any step above. Not refuse to leave when the station is closing. Not obstruct the officer or the transmission of results. Not confiscate anything. Not shout.
An agent who escalates into a confrontation converts a documented procedural complaint into an incident in which they are the subject, and hands the other side the story.
Rehearse the refusal at training
Run it as a role play, with somebody playing an exhausted presiding officer who says no. Do it three times, until the agent asks precisely, photographs without asking permission twice, objects without apologising, and calls their ward agent instead of arguing.
Ten minutes of rehearsal in 2026 buys you a usable record on 10 August 2027. Nothing you do after the declaration can.
Frequently Asked Questions
Is a Kenyan polling agent entitled to a copy of the results form?
Yes. An agent appointed by a candidate or party and accredited by the IEBC is entitled to a copy of the results form for the stream they are assigned to. If a copy is not produced, the agent should request permission to photograph the completed and signed form and object on the record.
What should an agent record when refused a results form?
In their own notebook, at the time: the date, the hour, the station name and code, the stream, the title of the person who refused, what was said, and who else witnessed it. Notes made contemporaneously carry weight in a dispute, and an account reconstructed days later carries very little.
How long does a campaign have to challenge a Kenyan election result?
A presidential petition is filed at the Supreme Court within seven days of declaration and determined within fourteen days. Other election petitions are filed within twenty-eight days of the declaration of the result. Those windows are far too short to assemble evidence that was not captured at the polling stream on the night.
