The Political Parties Disputes Tribunal Is Now a Campaign Venue
The Political Parties Disputes Tribunal was created to do something sensible: give members and parties a specialist forum for internal disputes instead of clogging the High Court with them.
It now sits close to the centre of Kenyan politics, and it is about to get much busier.
What the tribunal actually handles
Disputes between members of a party, between members and their party, between parties, between a coalition's members, and — critically — disputes arising from party nominations.
That last category is the one that matters for 2027, and it is the one that will arrive in volume.
Why it has become political
Because in a system where nominations are frequently decided by consensus or by a National Elections Board rather than by a members' vote, the tribunal is the only place an aggrieved aspirant can go.
So an institution designed as a dispute-resolution mechanism has become a de facto appeal against a party's internal politics — and parties, reasonably enough, treat it as an extension of the same fight.
The pattern recurs: a party takes a decision, the affected person obtains an order, the party proceeds anyway or reconstitutes the decision, and the matter moves up.
The 2027 collision nobody has planned for
Here is the specific problem, and it is arithmetic rather than opinion.
Party primaries for 2027 must be concluded, and internal disputes resolved, by 8 May 2027. The same date is the deadline for an aspirant to leave a party and file as an independent.
Now consider a primary held on 3 May. The aggrieved aspirant has five days to bring a dispute, have it heard, have it determined, and — if it fails — decide to run as an independent and file.
That is not a tight timetable. It is an impossible one, and it will apply to hundreds of aspirants simultaneously across the country in the first week of May 2027.
What an aspirant should do about it
Three things, all of them before the primary rather than after.
Read the nomination rules now. They are certified by the Registrar ahead of the cycle and they specify the internal dispute route and its timelines. A rule providing fourteen days for an internal appeal is a rule providing no appeal at all if your primary is held in May.
Decide your fallback in advance. Whether you would run independent has to be answered in March or April, not in the five days after a result.
Document everything as it happens. A tribunal decides on evidence. An aspirant who can produce dated records — who was on the members' list, what the party's own communications said, what happened at the primary polling points — is in a completely different position from one relying on recollection.
That last point is the practical one, and it is why we say elsewhere on this blog to put agents at your own primary. A photograph of a declared result at the point of declaration is the difference between a case and a grievance.

The volume problem coming in 2027
Consider the arithmetic.
Kenya has roughly 1,450 ward seats, 290 constituencies, 47 counties and several parties contesting most of them. If even a small percentage of primaries produce a dispute, the tribunal faces hundreds of matters compressed into the weeks before 8 May 2027.
That is not a resourcing problem that can be solved in April. It is one that would have to be anticipated now — more panels, longer sitting hours, clearer filing procedures — and there is no sign of it being planned for.
The practical consequence for an aspirant is straightforward and unwelcome: assume your dispute will not be heard in time. Plan on that basis, decide your fallback before the primary, and treat the tribunal as an outside possibility rather than as a safety net.
Frequently Asked Questions
What is Kenya's Political Parties Disputes Tribunal?
A specialist tribunal that resolves disputes between party members, between members and their parties, between parties and coalition partners, and disputes arising from party nominations.
How long will aspirants have to challenge a 2027 primary result?
Very little. Primaries and internal disputes must both be concluded by 8 May 2027, which is also the deadline to leave a party and file as an independent, so a primary held in early May leaves almost no room for either.
