Seven Days to File, Fourteen to Decide: Kenya's Presidential Petition Clock

Seven days to file. Fourteen days for the Supreme Court to decide. That is the entire life of a Kenyan presidential petition, start to finish, and it is shorter than the notice period on most employment contracts.

The compression is not an accident, and it is not a drafting oversight. It is the point.

Why the clock is that short, and what it does to a case

The presidency is the one office Kenya cannot leave in doubt.

Every other seat can sit vacant for a period without the state losing a function. A contested presidency cannot. The swearing-in follows the declaration on a fixed schedule, executive authority has to vest in somebody, and a country with two people claiming the office is a country with a crisis rather than a court case.

So the drafters made the dispute finish before the transition does. Seven days to file, fourteen to determine, one court, one shot, no appeal.

Fourteen days removes almost everything lawyers normally rely on.

There is no realistic time for discovery, for expert reports commissioned after the event, for tracing witnesses across the country, or for building a narrative out of material you did not already hold. Directions are given on a court-set timetable measured in hours and days, and parties file more or less simultaneously.

The practical consequence is blunt. A presidential petition is argued on evidence that existed before it was filed. Anything you have to go and look for afterwards will not arrive in time to be used.

Which is why the Form 34 chain is the whole battleground

A presidential result is built in three steps. Form 34A is completed at the polling station and signed there. Form 34B is the constituency tally. Form 34C is the national declaration.

Arithmetic between those three levels is checkable in days. It needs no witnesses, no travel and no interpretation. Either the number on the station form is the number carried upward, or it is not.

Allegations about motive, pressure or intent are the opposite. They need witnesses, and witnesses need time that this timetable does not contain.

Who may bring it

The presidential petition is open. Article 140 of the Constitution allows a person to petition the Supreme Court to challenge the election of a President elect, and it adds no test of who that person must be.

The respondents are ordinarily the IEBC and the person declared elected. The court can direct that others be joined where their conduct is in issue.

Standing being wide does not make the case easier. It makes the same fourteen days available to more people, and the same evidentiary problem applies to all of them.

The threshold the petition is arguing about

Worth remembering what is actually being contested. A presidential winner needs more than half of all votes cast and at least 25 per cent of the votes cast in each of at least 24 counties.

That is two separate conditions, and a petition can attack either. A challenge to the national majority is an argument about totals. A challenge to the county condition is an argument about a specific set of counties, which is a much smaller and more provable body of material.

What finality means here

The Supreme Court is the first and last court for a presidential petition. There is nowhere to appeal to, because there is nothing above it and no time in which an appeal could be heard.

For every other seat, an appeal exists and is confined to matters of law. Related: where election appeals go.

What a national campaign has to do before polling day

The seven-day clock means the evidence operation runs on 10 August 2027, not afterwards.

Name an agent for every polling stream and make sure each one leaves with a signed Form 34A copy. Build a single intake point that receives those copies the same night, county by county, so that by the morning after polling you know which stations you hold forms for and which you do not.

Retain counsel before polling day rather than after the declaration. A legal team appointed on day three of seven has lost nearly half the window to being briefed.

And decide in advance who has authority to instruct that a petition be filed. That decision cannot survive a week of committee meetings, because there is not a week.

Frequently Asked Questions

Why is Kenya's presidential petition timetable so short?

Because the presidency cannot be left in doubt while a court considers the matter. The swearing-in follows the declaration on a fixed schedule and executive authority has to vest somewhere. The Constitution therefore requires the dispute to be filed within 7 days and determined within 14 so it finishes before the transition does.

Can a Supreme Court decision on a presidential petition be appealed?

No. The Supreme Court is both the first and the last court for a presidential petition, so there is no appellate route above it. For other seats an appeal does exist, and it is confined to matters of law rather than a rehearing of the evidence.
