Kenya Kwanza and the Broad-Based Government: What's the Difference?

Kenya Kwanza is a registered coalition: an agreement William Ruto's United Democratic Alliance (UDA) signed with partner parties on 12 April 2022 to contest that year's election together. The broad-based government is a later political arrangement, begun in July 2024, under which Ruto brought senior figures from the Orange Democratic Movement (ODM) into his Cabinet, formalised by a UDA-ODM memorandum of understanding on 7 March 2025. The first decided who ran together in 2022. The second decides who governs together now, and both parties are negotiating whether it becomes an electoral pact for 2027.

Kenya Kwanza: a coalition built to win

Kenya Kwanza brought together UDA, Musalia Mudavadi's Amani National Congress (ANC), Moses Wetang'ula's Ford Kenya and smaller parties, including the Democratic Party then led by Justin Muturi. The agreement is a legal document deposited with the Registrar of Political Parties, and it has rules for leaving: the Democratic Party's secretary-general said in March 2025 that a partner could exit on 30 days' written notice.

Ruto won in August 2022. Mudavadi became Prime Cabinet Secretary and Wetang'ula Speaker of the National Assembly. How agreements like this are written and enforced is explained in how Kenyan coalition agreements actually work.

Kenya Kwanza has thinned since. The Democratic Party gave notice to leave in a letter dated 7 March 2025, the first partner to exit, Citizen Digital reported. UDA tried to absorb ANC, and on 22 January 2026 the High Court voided that merger; Mudavadi appealed. Ford Kenya has refused to fold into UDA.

The broad-based government: an arrangement built to govern

The broad-based government grew out of the June 2024 protests against the Finance Bill. On 11 July 2024 Ruto dismissed almost his entire Cabinet, keeping only Mudavadi. When he rebuilt it, four senior ODM politicians came in: John Mbadi at the Treasury, Opiyo Wandayi at Energy, Hassan Joho at Mining and the Blue Economy, and Wycliffe Oparanya at Co-operatives and small enterprises. Beatrice Askul, also ODM-affiliated, took the East African Community and ASALs docket.

There was no coalition agreement at that point. The written basis came later, when Ruto and Raila Odinga signed the UDA-ODM memorandum of understanding at KICC on 7 March 2025. It set a ten-point agenda built largely on the report of the National Dialogue Committee, with commitments on inclusivity in appointments and budgets, youth investment, and amnesty and compensation for people caught up in protests. The text is examined in what UDA and ODM actually agreed.

What the courts said

The arrangement was challenged in court. On 7 July 2026 a three-judge bench of the High Court dismissed petitions by Katiba Institute, Okiya Omtatah (Senator, Busia) and others against the ODM appointments. Justices Eric Ogola and Stephen Githinji held that political affiliation is not a constitutional bar to becoming a Cabinet Secretary, and that the Constitution does not recognise an official opposition as an institution, Kenyans.co.ke reported.

Justice Jairus Ngaah dissented. Bringing opposition members into Cabinet "outside constitutionally recognised coalition or merger arrangements", he wrote, blurred the line between government and opposition, and the broad-based government had no constitutional foundation, the Nation reported. In a separate judgment days earlier, the court had ordered the President to reconstitute the Cabinet within 120 days to meet the two-thirds gender rule.

The majority view is the law for now. The dissent matters because it names the gap: the broad-based government is not a coalition in the sense the Political Parties Act uses the word.

Why the difference matters for 2027

To field joint candidates, or to share out seats in a way the IEBC and the Registrar will recognise, UDA and ODM need a pre-election coalition agreement. The MoU does not do that job. The difference between a coalition and a coalition party, and what it means for the ballot, is in coalition or coalition party?.

The two parties are moving in that direction. ODM's delegates voted on 27 March 2026 to open talks with UDA on a pre-election agreement, and a joint technical team has been drafting a manifesto, as described in inside Naivasha. The terms are the hard part. At a Kisumu meeting on 14 September 2026, ODM deputy leader Simba Arati (Governor, Kisii) demanded "50-50 sharing of government", and ODM voices want the Deputy President's slot. That fight is covered in ODM wants half the government.

Kenya Kwanza's remaining partners have a stake too. Every seat UDA gives ODM in a shared deal is one that Ford Kenya, ANC or UDA's own aspirants cannot have. How UDA manages that is set out in UDA explained.

What to watch

Whether UDA and ODM sign and deposit a pre-election coalition agreement after ODM's memorial programme, which was planned to finish in Nairobi on 31 October 2026. Whether it names a running mate or leaves the question open. And whether Kenya Kwanza's original partners sign it as well, or stay in a 2022 agreement that says nothing about ODM.

Frequently Asked Questions

What is the difference between Kenya Kwanza and the broad-based government?

Kenya Kwanza is the coalition agreement UDA signed with ANC, Ford Kenya and others on 12 April 2022 to win that election. The broad-based government is the arrangement from July 2024 that brought ODM leaders into Ruto's Cabinet, formalised by a UDA-ODM memorandum of understanding on 7 March 2025.

Which ODM leaders joined Ruto's Cabinet?

John Mbadi (Treasury), Opiyo Wandayi (Energy), Hassan Joho (Mining and Blue Economy) and Wycliffe Oparanya (Co-operatives) joined in 2024, along with Beatrice Askul (East African Community and ASALs).

Is the broad-based government constitutional?

On 7 July 2026 the High Court, by a 2-1 majority, upheld the appointment of ODM figures to the Cabinet. Justice Jairus Ngaah dissented, saying the arrangement had no constitutional foundation.

Are UDA and ODM in a coalition for 2027?

Not yet. ODM's delegates voted in March 2026 to open talks on a pre-election agreement, and a joint team is drafting a manifesto, but no coalition agreement had been signed by 23 September 2026.
